Please read this privacy notice carefully, as it contains important information on who we are, how and why we collect, store, use, and share personal information. It also describes your rights in relation to your personal information and on how to contact us and supervisory authorities if there’s a dispute.

We strive to educate parents and kids about how to appropriately safeguard their privacy when using the Mathstronaut game and related services. We are committed to complying with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), which requires us to inform parents and legal guardians about our information collection and use practices. COPPA also requires that we obtain parental consent before we allow children under the age of 13 to access or use our Service.

We urge kids to check with their parents before entering information through our game or website, and we recommend that parents discuss any restrictions regarding the online release of personal information with their kids to anyone they don’t know. Please see the section below labeled “Children’s Privacy” for more information on our privacy practices with regard to children under 13.

Who we are

Ditch Wizard LLC (“Ditch Wizard,” “We,” or “Us”) collects, uses and is responsible for certain personal information about you, as part of the “Mathstronaut” mobile app and its related website, located at www.mathstronaut.com (together, the “Service”).

For those in the European Union, we are regulated under the General Data Protection Regulation which applies across the European Union (including in the United Kingdom) and we are responsible as controller of that personal information for the purposes of those laws.

The Personal Information we collect and use

Information collected by us: We collect the following personal information either automatically or when you voluntarily provide it to us:

A first name and a chosen grade level are collected by the Mathstronaut mobile app, in order to personalize the player’s experience with the app. However, this information is kept only on the user’s device, and not transferred to us or any third party.

Your name and email address are collected when you contact us about a Service-related issue or support ticket, or sign up for our newsletter or other marketing emails (your “Contact Information”). On the Mathstronaut mobile app, we request that only a parent or guardian’s email address is entered, and ask an age verification question prior to accepting this information, in order to avoid collecting this information from users under 13 years old. Additionally, we use a two-step confirmation process to confirm that the person signing up is indeed the parent or guardian. The legal basis for collecting this information is to fulfill a contract with you, under GDPR Art. 6 (1) (b).

Your anonymized platform type, hardware settings, hardware components, and software version if you have a technical support issue (your “Technical Information”). The legal basis for collecting this information is to fulfill a contract with you, under GDPR Art. 6 (1) (b).

Certain anonymous gameplay session information, such as play time, bounce rate, and other analytic info (your “Analytic Information”). Note that this information is collected anonymously and cannot be used to personally identify you.

How we use your Personal Information: We use your personal information as follows:

Technical Support: We use your Contact Information and Technical Information, as needed, to provide you with technical support for the Service.

Communications: We use your Contact Information to send newsletters and other marketing emails to you.

Who we share your Personal Information with: In operating the Service, we may share certain personal information with others:

Communications: We use Mailchimp to collect the Contact Information for the purposes of sending newsletters and other marketing emails to you. You can view their privacy policy here.

Analytics: We share anonymous Analytic Information with our analytics provider, Google Analytics, in order to analyze usage of the Service and make improvements. You can view their privacy policy here.

Other Sharing: We may share your personal information if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) it is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the Service, or (iii) it is appropriate to protect the rights, property or safety of our company, our employees, clients, or users of the Service.

We will not share your personal information with any other third party.

How long your Personal Information will be kept: We will keep your personal information for the length of time required to provide you with the Service, unless a longer retention period is required by law. Afterwards, we delete all personal information in our possession within a reasonable timeframe. We do not verify the correctness of personal data that we collect or you provide.

Please note that some data may be retained if necessary to resolve disputes, enforce our user agreements, and comply with technical and legal requirements and constraints related to the security, integrity, and operation of the Service.

“Do Not Track” signals: “Do Not Track” is a preference you can set in your web browser to inform websites that you don’t want to be tracked across various websites. We currently do not support Do Not Track browser signals.

Third-party links: Please be aware that when you click on a third party logo or link displayed on the Service that links you to a different website, our Privacy Policy no longer applies and you must read the third party’s privacy policy to see how your personal information will be handled by them. If you can’t find their privacy policy, then you should contact the service’s owners to get that information. We are not responsible for their collection and use of your personal information. 

We specifically recommend that any children using the Service check with their parent or guardian before visiting any third party sites or apps.

Children’s Privacy

We encourage all parents and guardians to actively participate in and supervise their children’s usage of the Internet and mobile apps. We believe that it’s important to teach children not to give out their real names, addresses, phone numbers, birthdays, and other identifiable information online.

Because we operate a mobile app for children, we recognize the great responsibility to those users under 13. That’s why we don’t collect, store, or share any personal information from those users. Even though the Mathstronaut game asks for the user’s first name and grade level to personalize the gameplay experience, this information is only stored on their device and is never sent to us.

Additionally, in order to stay compliant with COPPA, we have adopted the following policies across the board:

We will never request any more information than is reasonably necessary to use the Service;

We will always allow you, the parent or guardian, to review any personal information we may have collected from your child under the age of 13. You can then direct us to delete it and to stop any future collection from them;

We will allow you to direct us to collect personal information from your child under the age of 13, but to not share that information with any third parties; and

If you would ever like to take any of the above actions or have any questions about children’s privacy, you can always contact us at support@ditchwizard.com.

If we learn that we’ve collected personal information from a user under the age of 13 without parental consent or beyond what’s been requested, we will delete that information as quickly as possible.

If you believe that someone under the age of 13 may have provided us personal information in violation of this Privacy Policy, please contact us at support@ditchwizard.com.

If, at any time, we do require the collection of personal information from anyone under the age of 13, we will do our best to notify their parent or guardian. This notification will include the exact information being collected and how it is being used and shared with any third parties. This will also allow the parent or guardian to prevent this collection and use. We will obtain this verifiable parental consent through the methods which may be offered at the time, including:

signing a consent form and sending it back via fax, mail, or email;

calling a toll-free number or using a video conference; or

answering a series of knowledge-based challenge questions that would be difficult for someone other than the parent to answer.

For personal information used strictly for internal purposes, we will have the parent or guardian consent via email, which they can revoke at any time.

Transfer of your Information out of the EEA

Ditch Wizard is based in the United States. No matter where you are located, you consent to the processing, transfer, and storage of your information in and to the United States, in accordance with this Privacy Policy and the privacy policies of third parties with whom we share your Personal Information. The laws of the U.S. and other countries governing data collection and use may not be as comprehensive or protective as the laws of the country where you live.

EU Residents – Your Rights

Under the laws of some jurisdictions, including the General Data Protection Regulation in the EEA, you have a number of important rights with regard to your Personal Information.

By law, you can ask us what information we hold about you, and you can ask us to correct it if it is inaccurate. If we have asked for your consent to process your personal data, you may withdraw that consent at any time.

If we are processing your personal data for reasons of consent or to fulfil a contract, you can ask us to give you a copy of the information in a machine-readable format so that you can transfer it to another provider.

If we are processing your personal data for reasons of consent or legitimate interest, you can request that your data be erased.

You have the right to ask us to stop using your information for a period of time, if you believe we are not doing so lawfully.

Finally, in some circumstances, you can ask us not to reach decisions affecting you using automated processing or profiling.

Resolving Disputes

We hope that we can resolve any questions or concern you raise about our use of your Personal Information. Please contact us via the methods listed below in the “How to contact us” section to let us know about any of your questions or concerns, and we will get back to you to resolve the issue.

If you are an EU citizen, the General Data Protection Regulation also gives you right to lodge a complaint with a supervisory authority, in particular in the European Union (or European Economic Area) state where you work, normally live, or where any alleged infringement of data protection laws occurred.

This privacy notice was last updated on March 5th, 2020.

We may change this Privacy Policy from time to time. When we do, we will inform you via the Contact Information that you have provided us, or by posting a message about the change on the Service.
